The Secretary of State, in exercise of the powers conferred by section 39(3) and (4) of the Energy Act 2004(1), makes the following Order:
1. This Order may be cited as the Energy Act 2004 (Designation of Publicly Owned Companies) Order 2007 and shall come into force on 31st December 2007.
2. British Nuclear Fuels plc (registered number 5027024) is a company designated for the purposes of section 39(3) of the Energy Act 2004.

This Order designates British Nuclear Fuels plc as a company falling within section 39(3) of the Energy Act 2004(2).
For the purposes of section 39(4) of that Act, British Nuclear Fuels plc is a publicly owned company to which property, rights or liabilities of BNFL were transferred at a time when both British Nuclear Fuels plc and BNFL were publicly owned. By virtue of section 39(2) of that Act the securities, property, rights and liabilities of such a company may be transferred to a publicly owned company, the NDA or a consenting person by a scheme under section 38 of that Act.
No Regulatory Impact Assessment has been carried out as this Order will have no impact on business or the voluntary sector.
