The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community.

These Regulations make provision for a purpose mentioned in that section and it appears to the Secretary of State that it is expedient for the reference to Commission Regulation (EC) No 2707/2000(3) laying down rules for applying Council Regulation (EC) No 1255/1999 as regards Community aid for supplying milk and certain milk products to pupils in educational establishments to be construed as a reference to that instrument as amended from time to time.

The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972(4).

Title and commencement

1.  These Regulations—

(a)may be cited as the Milk and Milk Products (Pupils in Educational Establishments) (England) (Amendment) Regulations 2007; and

(b)come into force on 1st January 2008.

Amendment

2.—(1) Regulation 2 of the Milk and Milk Products (Pupils in Educational Establishments) (England) Regulations 2001(5) is amended as follows.

(2) For the definition of “the Commission Regulation”, substitute—

“the Commission Regulation” means Commission Regulation (EC) No 2707/2000 laying down rules for applying Council Regulation (EC) No 1255/1999 as regards Community aid for supplying milk and certain milk products to pupils in educational establishments, as amended from time to time;.

(3) For the definition of “the Council Regulation”, substitute—

“the Council Regulation” means Council Regulation (EC) No 1255/1999(6) on the common organisation of the market in milk and milk products;.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which apply only in England, amend regulation 2 of the Milk and Milk Products (Pupils in Educational Establishments) (England) Regulations 2001 (S.I. 2001/994). The definitions of “the Commission Regulation” and “the Council Regulation” are amended to take account of—

(a)amendments to Commission Regulation (EC) No 2707/2000 laying down rules for applying Council Regulation (EC) No 1255/1999 as regards Community aid for supplying milk and certain milk products to pupils in educational establishments (and references to Commission Regulation (EC) No 2707/2000 are references to that Regulation as amended from time to time); and

(b)amendments to Council Regulation (EC) No 1255/1999 on the common organisation of the market in milk and milk products.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
