Subject to regulation 36 (merging companies may select standard rules of employee participation), each merging company shall make arrangements for the establishment of a special negotiating body.

The task of the special negotiating body shall be to reach an employee participation agreement with the merging companies (see Chapter 3).

The special negotiating body shall be constituted in accordance with regulation 26.
