Coming into force

The Lord Chancellor makes the following Order in exercise of the powers conferred by section 92 of the Courts Act 20031.

In accordance with section 92(1) of the Courts Act 2003 he has obtained the consent of the Treasury.

In accordance with section 92(5) and (6) of the Courts Act 2003 he has consulted the Lord Chief Justice, the Master of the Rolls, the President of the Queen’s Bench Division, the President of the Family Division, the Chancellor of the High Court, the Head of Civil Justice, the Deputy Head of Civil Justice and the Civil Justice Council.

This Order may be cited as the Family Proceedings Fees (Amendment) (No.2) (Amendment) Order 2007 and shall come into force on 28th September 2007.

The Family Proceedings Fees (Amendment) (No. 2) Order 20072 is amended in accordance with the following articles.

In column 1 in fee 8.2 in Schedule 1 in the Schedule omit the words “(excluding VAT and disbursements)”.

For paragraph 2(1)(b) in Schedule 1A in the Schedule substitute—

b

is in receipt of legal advice and assistance under Part II or Part III of the Legal Aid Act 1988 in connection with the matter to which the proceedings relate; or
