The Secretary of State for Health makes the following Order in exercise of the powers conferred on him by section 273(1) of, and paragraph 28(1) of Schedule 4 to, the National Health Service Act 2006(1).
The Secretary of State for Health considers it appropriate in the interests of the health service to dissolve the Staffordshire Ambulance Service National Health Service Trust and has completed the consultation prescribed under paragraph 28(3) of Schedule 4 to the National Health Service Act 2006(2).
See the National Health Service Trusts (Consultation on Establishment and Dissolution) Regulations 1996 (S.I. 1996/653, as amended by S.I. 2001/3788), which were made under paragraph 29(3) of Schedule 2 to the National Health Service and Community Care Act 1990 (c. 19) (“1990 Act”). That paragraph of Schedule 2 to the 1990 Act was re-enacted by paragraph 28(3) of Schedule 4 to the National Health Service Act 2006 (“2006 Act”) and repealed by section 6 of, and Schedule 4 to, the National Health Service (Consequential Provisions) Act 2006 (c. 43). Section 4 of, and paragraph 1(2) of Schedule 2 to, that Act provide that subordinate legislation made under any repealed and re-enacted provision of the 1990 Act has effect as if made under the corresponding provision of the 2006 Act.
