The Private Security Industry Act 2001 Regulations (Amendment) Regulations 2007

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 4, 8, 15(8), 24(1) and 24(5) of the Private Security Industry Act 2001(1), having regard to the definition of “prescribed” in section 24(1) of that Act.

In accordance with section 24(4)(2) of that Act he has consulted with the Scottish Ministers and the Security Industry Authority.

Citation, commencement and extent

1.—(1) These Regulations may be cited as The Private Security Industry Act 2001 Regulations (Amendment) Regulations 2007 and shall come into force on 1st October 2007.

(2) These Regulations extend to England, Wales and Scotland.

Extension of the Private Security Industry Act 2001 (Exemption) (Aviation Security) Regulations 2006(3) to Scotland

2.  The Private Security Industry Act 2001 (Exemption) (Aviation Security) Regulations 2006 are amended by inserting “and Scotland” after “Wales” in Regulation 1(2).

Amendment to the Private Security Industry Act 2001 (Approved Contractor Scheme) Regulations 2007(4)

3.  The Private Security Industry Act 2001 (Approved Contractor Scheme) Regulations 2007 are amended by substituting “£17” for “£20” in Regulation 5.

Amendments to the Private Security Industry Act 2001 (Licences) Regulations 2007(5)

4.—(1) The Private Security Industry Act 2001 (Licences) Regulations 2007 are amended by

(a)inserting the words “any other” before “non-front” and by deleting the words after the second “conduct” in Regulation 7(1) and

(b)by substituting the form set out in Schedule 1 for the form in Schedule 1 to those Regulations.

(2) An application made on a form prescribed by Schedule 1 to The Private Security Industry Act 2001 (Licences) Regulations 2007, as it was in force before the commencement of these Regulations, shall be deemed to have been made on the corresponding form prescribed by Schedule 1 to these Regulations if received on or before 31st March 2008.

SCHEDULE 1

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend two sets of Regulations made under the Private Security Industry Act 2001 and extend a third to Scotland.

Regulation 2 extends the Private Security Industry Act 2001 (Exemption) (Aviation Security) Regulations 2006 to Scotland. Previously these Regulations only applied to England and Wales.

Regulation 3 amends Regulation 5 of the Private Security Industry Act 2001 (Approved Contractor Scheme) Regulations 2007. The amendment substitutes a fee of £17 for the previous fee of £20 for the annual fee to be paid by an approved person in respect of each person undertaking licensable conduct on behalf of him or under his direction.

Regulation 4 amends the Private Security Industry Act 2001 (Licences) Regulations 2007. The first amendment amends Regulation 7 to allow a licensed person to engage in non-front line licensable conduct in any other category of licensable activity. The second amendment replaces the form prescribed for the purposes of section 8(2)(a) of the Private Security Industry Act 2001 with a new form, as set out in Schedule 1 to this Order. Regulation 4(2) is a transitional provision allowing the existing application form to be used until 31st March 2008.
