and measures relating to the abolition of restrictions on the import and export of goods.</p><formula name="enactingText"><p>The Secretary of State makes the following Regulations, in exercise of the powers conferred by that section.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as The Gambling Act 2005 (Repeal) (Remote Operating Licence and Credit) Regulations 2007, and come into force on 1st September 2007.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Repeal of certain provisions of the 2005 Act</heading><num>2.</num><intro><p>The following provisions of the Gambling Act 2005<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/2005/19">2005 c.19</ref>.</p></authorialNote> are repealed—</p></intro><level class="para1" eId="regulation-2-a"><num>(a)</num><content><p>subsections (2) and (3) of section 89 (remote gambling equipment operating licence condition);</p></content></level><level class="para1" eId="regulation-2-b"><num>(b)</num><content><p>subsection (1)(d) of section 117 (regulatory powers following a review); and</p></item><item><p>section 245 (credit) which makes it an offence for a person to supply, install or make available a gaming machine which is designed or adapted to permit money to be paid by credit card.</p></item></blockList></blockContainer><blockContainer ukl:Name="P"><p>These Regulations ensure that the <abbr class="acronym" title="United Kingdom">UK</abbr>’s obligations to notify technical standards in draft to the European Commission, under the Technical Standards Directive (Directive <ref eId="c00001" href="http://www.legislation.gov.uk/european/directive/1998/0034">98/34/<abbr class="acronym" title="European Community">EC</abbr></ref>, as amended by Directive <ref eId="c00002" href="http://www.legislation.gov.uk/european/directive/1998/0048">98/48/<abbr class="acronym" title="European Community">EC</abbr></ref>), can be complied with. Equivalent measures to those contained in the repealed provisions will be achieved by alternative means, and notified to the European Commission as appropriate.</p></blockContainer><blockContainer ukl:Name="P"><p>No Regulatory Impact Assessment has been prepared as these Regulations are a technical instrument.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
