The Education (Individual Pupil Information) (Prescribed Persons) (Amendment) Regulations 2007

The Secretary of State for Children, Schools and Families, in exercise of the powers conferred by sections 537A(4), (5) and (6) and 569(4) of the Education Act 1996(1), makes the following Regulations:

Citation, commencement and application

1.  These Regulations may be cited as the Education (Individual Pupil Information) (Prescribed Persons) (Amendment) Regulations 2007 and come into force on 1st September 2007.

2.  These Regulations apply to individual pupil information relating to pupils at schools in England only.

Amendment

3.—(1) Regulation 3 (Prescribed persons) of the Education (Individual Pupil Information) (Prescribed Persons) Regulations 1999(2) is amended as follows.

(2) in paragraph (4)—

(a)in sub-paragraph (b), omit the word “General”;

(b)after “(n) the Welsh Joint Education Committee” insert the following—

(o)the Secretary of State for Work and Pensions;

(p)the Secretary of State for Innovation, Universities and Skills;

(q)the Student Loan Company Limited;

(r)the University and Colleges Admissions Service(3);

(s)the Higher Education Statistics Agency(4);

(t)Ufi Limited(5);

(u)any person with whom the Secretary of State has made arrangements under section 114(2) of the Learning and Skills Act 2000(6);

(u)any person who, either alone or jointly with others, awards or authenticates any qualification accredited by the Qualifications and Curriculum Authority(7)..

(3) for paragraph (5) substitute the following paragraph—

(5) The categories referred to in paragraphs (1)(b), (2)(b) and (2A)(b) are—

(a)institutions within the further education sector;

(b)Primary Care Trusts(8);

(c)work-based learning providers;

(d)persons conducting research into the educational achievements of pupils and who require individual pupil information for that purpose;

(e)learning providers registered with the UK Register of Learning Providers(9);

(f)institutions within the higher education sector..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Education (Individual Pupil Information) (Prescribed Persons) Regulations 1999 so as to include as prescribed persons those listed in regulation 4(1) and to include as categories of prescribed persons those listed in regulation 4(2). These prescriptions are for the purposes of providing and receiving information on individual pupils.

Regulation 3(2)(a) makes a consequential amendment on the name change of the Joint Council for General Qualifications to the Joint Council for Qualifications.

The Higher Education Statistics Agency is a company limited by guarantee registered in England No. 2766993.

Ufi Limited is a company limited by guarantee and registered in England No. 3980770.

The Qualifications and Curriculum Authority is established under section 21 of the Education Act 1997 (c. 44).

Primary Care Trusts are established under section 18 of the National Health Service Act 2006 (c. 41).

The UK Register of Learning Providers is jointly subcontracted to Ufi Limited by the Department for Innovation, Universities and Skills and the Learning and Skills Council for the purposes of verifying the legal status of learning providers.
