Citation and commencement

1.  This Order may be cited as the Railways Pensions Guarantee (Prescribed Persons) Order 2007 and shall come into force on 1st August 2007.

Prescribed persons

2.  For the purpose of determining whether the 1994 Pensioners’ Section of the Railways Pension Scheme (2) satisfies the conditions in paragraph 11(3) of Schedule 11 to the Railways Act 1993 there shall be disregarded the membership of that section of any persons admitted to membership of that section with effect from 30th December 2000 who were formerly members of the BR Section of the Railways Pension Scheme.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order prescribes classes of persons whose membership of the 1994 Pensioners Section of the Railways Pension Scheme is to be disregarded for the purpose of determining whether that section satisfies the conditions in paragraph 11(3) of Schedule 11 to the Railways Act 1993. The prescribed persons are those admitted to membership of that section with effect from 30th December 2000 who were formerly members of the BR section of the Railways Pension Scheme.

A regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business, charities, voluntary bodies or the private sector.

The Railways Pension Scheme was established by the Railways Pension Scheme Order 1994 (S.I. 1994 No. 1433) which was amended by the Railway Pensions (Transfer and Miscellaneous Provisions) Order 1994 (S.I. 1994/2005) and section 215 (6) of the Transport Act 2000 (2000 c. 38).
