The Commonhold and Leasehold Reform Act 2002 (Commencement No.6) (England) Order 2007

The Secretary of State(1), in exercise of the powers conferred by section 181 of the Commonhold and Leasehold Reform Act 2002(2), makes the following Order:

Citation, application and interpretation

1.—(1) This Order may be cited as the Commonhold and Leasehold Reform Act 2002 (Commencement No.6) (England) Order 2007.

(2) This order applies to England only.

Provision coming into force on 1st October 2007

2.  Section 153 of the Commonhold and Leasehold Reform Act 2002 shall come into force on 1st October 2007 to the extent it is not already in force.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force section 153 of the Commonhold and Leasehold Reform Act 2002 (“the Act”) in relation to England.

Section 153 of the Act inserts section 21B into the Landlord and Tenant Act 1985, which requires that a demand for service charges must be accompanied by a summary of the rights and obligations of the tenant.

The powers conferred by section 181 of the Commonhold and Leasehold Reform Act 2002 (c.15) are exercisable by the appropriate authority. “Appropriate authority” is defined in section 181(4) of that Act and means, in relation to any provision of Part 2 of that Act, the Secretary of State as respects England.
