The Dissolution of the Post Office Order 2007

The Secretary of State makes the following Order in exercise of the power conferred upon him by section 75(2) of the Postal Services Act 2000(1).

In accordance with section 75(2) of that Act he has consulted the Post Office and Royal Mail Holdings plc(2).

In accordance with section 75(3) of that Act he is satisfied that nothing further remains to be done by the Post Office under paragraph 9 of Schedule 3 to that Act or under an order made under that Act:

1.  This Order may be cited as the Dissolution of the Post Office Order 2007.

2.  The Post Office shall be dissolved on 1st May 2007.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order dissolves the Post Office.

All property, rights and liabilities of the Post Office were transferred to Royal Mail Holdings plc (then called Consignia plc) on 26th March 2001, by virtue of section 62 of the Postal Services Act 2000.

Following that date the Post Office and Royal Mail Holdings plc were required by paragraph 9 of Schedule 3 to that Act to take all such steps as were necessary to secure that the vesting in Royal Mail Holdings plc by virtue of section 62 of that Act of any foreign property, right or liability is effective under the relevant foreign law.

See the definition of “the Post Office company” in section 62(8) of the Postal Services Act 2000. Article 3 of the Post Office Company (Nomination and Appointed Day) Order 2001 (S.I. 2001/8 (C.1)) nominated Consignia plc (company number 4074919) for the purposes of section 62 of the Postal Services Act 2000. Consignia plc changed its name to Consignia Holdings plc on 25th January 2001 and to Royal Mail Holdings plc on 4th November 2002.
