The Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 3) (Amendment) Order 2007

The Secretary of State for Health makes the following Order in exercise of the powers conferred by section 199(1) and (3) of the Health and Social Care (Community Health and Standards) Act 20031. In accordance with section 199(2)(b)(iv) of that Act, she has consulted the National Assembly for Wales.

Citation and application1.

(1)

This Order may be cited as the Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 3) (Amendment) Order 2007.

(2)

This Order applies in relation to England and Wales.

Amendment of the Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 3) Order 20042.

In article 3(4) of the Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 3) Order 20042, for the words “in respect of England.” there shall be substituted the words “in respect of England, save that section 50(1) is not commenced by this Order in respect of a review or the award of a performance rating in relation to the NHS Direct Special Health Authority3.”.

EXPLANATORY NOTE
(This note is not part of the Order)

Article 2 of this Order amends the Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 3) Order 2004 so that that Order does not commence section 50(1) of the Health and Social Care (Community Health and Standards) Act 2003. The effect is to obviate the need for a review and award of a performance rating in relation to the NHS Direct Special Health Authority in its final year of existence as a special health authority.
