1.—(1) This Order may be cited as the Surrey and Borders Partnership National Health Service Trust (Originating Capital) Order 2006 and shall come into force on 31st March 2006.
(2) This Order applies in relation to England.
2. The originating capital of the Surrey and Borders Partnership National Health Service Trust(3) shall be £206,376,000.

This Order determines the amount of originating capital, provided for in section 9 of the National Health Service and Community Care Act 1990, of the Surrey and Borders Partnership NHS Trust established under that Act on 1st April 2005.
1990 c. 19; section 9(1) was amended by section 15 of the Health Act 1999 (c. 8) (“the 1999 Act”). The functions of the Secretary of State under this provision are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 (“the 1999 Order”); for the reference to the National Health Service and Community Care Act 1990, see entry in Schedule 1 of the 1999 Order, as amended by section 66(4) and (5)(b) of the 1999 Act.
