<P1group TerritorialApplication="E" RestrictExtent="E+W" RestrictStartDate="2026-05-01"><Title>Exempt tenancies or licences for the purposes of Part 3 of the Housing Act 2004</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2" id="article-2"><Pnumber><CommentaryRef Ref="key-fbbc1d30c9d675f979d343647ee40ebb"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1" id="article-2-1"><Pnumber>1</Pnumber><P2para><Text>A tenancy or licence of a house or a dwelling contained in a house is an exempt tenancy or licence for the purposes of Part 3 of the Housing Act 2004 (“the Act”) if it falls within any of the following descriptions—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/a" id="article-2-1-a"><Pnumber>a</Pnumber><P3para><Text>a tenancy or licence of a house or dwelling that is subject to a prohibition order made under section 20 of the Act whose operation has not been suspended in accordance with section 23 of the Act;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/b" id="article-2-1-b"><Pnumber>b</Pnumber><P3para><Text>a tenancy described in any of the following provisions of Part 1 of Schedule 1 to the Housing Act 1988<FootnoteRef Ref="f00003"/>, which cannot be an assured tenancy by virtue of section 1(2) of that Act—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/b/i" id="article-2-1-b-i"><Pnumber>i</Pnumber><P4para><Text>paragraph 4 (business tenancies);</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/b/ii" id="article-2-1-b-ii"><Pnumber>ii</Pnumber><P4para><Text>paragraph 5 (licensed premises) <FootnoteRef Ref="f00004"/>;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/b/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/b/iii" id="article-2-1-b-iii"><Pnumber>iii</Pnumber><P4para><Text>paragraph 6 (tenancies of agricultural land); or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/b/iv" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/b/iv" id="article-2-1-b-iv"><Pnumber>iv</Pnumber><P4para><Text>paragraph 7 (tenancies of agricultural holdings etc) <FootnoteRef Ref="f00005"/>;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/c" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/c" id="article-2-1-c"><Pnumber>c</Pnumber><P3para><Text>a tenancy or licence of a house or a dwelling that is managed or controlled by —</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/c/i" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/c/i" id="article-2-1-c-i"><Pnumber>i</Pnumber><P4para><Text>a local housing authority;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/c/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/c/ii" id="article-2-1-c-ii"><Pnumber>ii</Pnumber><P4para><Text>a police authority established under section 3 of the Police Act 1996<FootnoteRef Ref="f00006"/>;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/c/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/c/iii" id="article-2-1-c-iii"><Pnumber>iii</Pnumber><P4para><Text>the Metropolitan Police Authority established under section 5B of the Police Act 1996;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/c/iv" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/c/iv" id="article-2-1-c-iv"><Pnumber>iv</Pnumber><P4para><Text>a fire and rescue authority under the Fire and Rescue Services Act 2004<FootnoteRef Ref="f00007"/>; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/c/v" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/c/v" id="article-2-1-c-v"><Pnumber>v</Pnumber><P4para><Text>a health service body within the meaning of section 4 of the National Health Service and Community Care Act 1990<FootnoteRef Ref="f00008"/>;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/d" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/d" id="article-2-1-d"><Pnumber>d</Pnumber><P3para><Text>a tenancy or licence of a house which is not a house in multiple occupation for any purposes of the Act (except Part 1) by virtue of—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/d/i" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/d/i" id="article-2-1-d-i"><Pnumber>i</Pnumber><P4para><Text>paragraph 3 of Schedule 14 to the Act (buildings regulated otherwise than under the Act); or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/d/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/d/ii" id="article-2-1-d-ii"><Pnumber>ii</Pnumber><P4para><Text>paragraph  <Substitution ChangeId="key-dcdca5a3cac18777849a085b947f4ec1-1778582475899" CommentaryRef="key-dcdca5a3cac18777849a085b947f4ec1">3A</Substitution>  of that Schedule (buildings occupied by students <Addition ChangeId="key-a1d9d88351e8766c11308d285c4741d3-1778582541161" CommentaryRef="key-a1d9d88351e8766c11308d285c4741d3">: England</Addition>)<FootnoteRef Ref="f00009"/>;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/e" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/e" id="article-2-1-e"><Pnumber>e</Pnumber><P3para><Text>a tenancy of a house or a dwelling where—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/e/i" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/e/i" id="article-2-1-e-i"><Pnumber>i</Pnumber><P4para><Text>the full term of the tenancy is more than 21 years;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/e/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/e/ii" id="article-2-1-e-ii"><Pnumber>ii</Pnumber><P4para><Text>the lease does not contain a provision enabling the landlord to determine the tenancy, other than by forfeiture, earlier than at end of the term; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/e/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/e/iii" id="article-2-1-e-iii"><Pnumber>iii</Pnumber><P4para><Text>the house or dwelling is occupied by a person to whom the tenancy was granted or his successor in title or any members of such person’s family;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/f" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/f" id="article-2-1-f"><Pnumber>f</Pnumber><P3para><Text>a tenancy or licence of a house or a dwelling granted by a person to a person who is a member of his family where—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/f/i" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/f/i" id="article-2-1-f-i"><Pnumber>i</Pnumber><P4para><Text>the person to whom the tenancy or licence is granted occupies the house or dwelling as his only or main residence;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/f/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/f/ii" id="article-2-1-f-ii"><Pnumber>ii</Pnumber><P4para><Text>the person granting the tenancy or licence is the freeholder or the holder of a lease of the house or dwelling the full term of which is more than 21 years; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/f/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/f/iii" id="article-2-1-f-iii"><Pnumber>iii</Pnumber><P4para><Text>the lease referred to in sub-paragraph (ii) does not contain a provision enabling the landlord to determine the tenancy, other than by forfeiture, earlier than at end of the term;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/g" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/g" id="article-2-1-g"><Pnumber>g</Pnumber><P3para><Text>a tenancy or licence that is granted to a person in relation to his occupancy of a house or a dwelling as a holiday home; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/1/h" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/1/h" id="article-2-1-h"><Pnumber>h</Pnumber><P3para><Text>a tenancy or licence under the terms of which the occupier shares any accommodation with the landlord or licensor or a member of the landlord’s or licensor’s family.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/2" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/2" id="article-2-2"><Pnumber>2</Pnumber><P2para><Text>For the purposes of this article—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/2/a" id="article-2-2-a"><Pnumber>a</Pnumber><P3para><Text>a person is a member of the same family as another person if—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/2/a/i" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/2/a/i" id="article-2-2-a-i"><Pnumber>i</Pnumber><P4para><Text>those persons live as a couple;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2006/370/article/2/2/a/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2006/370/article/2/2/a/ii" id="article-2-2-a-ii"><Pnumber>ii</Pnumber><P4para><Text>one of them is the relative of the other; <Text>This Order specifies the descriptions of tenancies and licences of houses, or of dwellings contained in houses, that are exempt tenancies or licences for the purposes of Part 3 of the Housing Act 2004 (“<Abbreviation Expansion="Housing Act 2004 c. 34">the Act</Abbreviation>”). The effect of the exemption is that Part 3 of the Act does not apply to houses in England that are subject to a tenancy or licence described in article 2 and they are not, therefore, subject to the licensing requirements described in section 85 of the Act.</Text>
