The Secretary of State makes the following Order in exercise of the powers conferred by section 358(1) and (2) of the Gambling Act 2005(1):

1.  This Order may be cited as the Gambling Act 2005 (Commencement No. 6 and Transitional Provisions) (Amendment) Order 2006.

2.—(1) The Gambling Act 2005 (Commencement No. 6 and Transitional Provisions) Order 2006(2) shall be amended as follows.

(2) In Column 1 of Schedule 1, for “Sections 80, 81” substitute “Section 80 (to the extent that that section is not already in force) and sections 81”.

(3) In Column 1 of Schedule 2, omit “Section 285”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Gambling Act 2005 (Commencement No. 6 and Transitional Provisions) Order 2006 (“the Commencement Order”) and is made in consequence of defects in that Order. The Order deletes the reference to section 285 in Schedule 2 to the Commencement Order (which lists the provisions coming into force on 30th April 2007). A reference to that section already appears in Schedule 1 (which lists the provisions coming into force on 1st January 2007). The Order also amends the reference to section 80 in Schedule 1 to make it clear that that provision is brought into force on 1st January 2007 only to the extent that it is not already in force.
