The Housing Act 2004 (Commencement No. 6)(England) Order 2006

The Secretary of State, in exercise of the powers conferred by sections 270(4) and (5)(c) of the Housing Act 2004(1), makes the following Order:

Citation and application

1.—(1) This Order may be cited as the Housing Act 2004 (Commencement No. 6) (England) Order 2006.

(2) This Order applies in relation to England only.

Commencement

2.  The following provisions of the Housing Act 2004 shall come into force on 2nd January 2007—

(a)section 225(2) insofar as it is not already in force;

(b)section 226;

(c)section 265(1) insofar as it relates to paragraph 47 of Schedule 15.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings sections 225 (duties of local housing authorities: accommodation needs of gypsies and travellers) and 226 (guidance in relation to section 225) of, and paragraph 47 of Schedule 15 (housing strategies and statements under section 87 of the Local Government Act 2003 )) to, the Housing Act 2004 into force in England on 2nd January 2007.

2004 c.34. The powers conferred by sections 270(4) and (5) are exercisable, as respects England, by the Secretary of State and, as respects Wales, by the National Assembly for Wales. See the definition of the appropriate national authority in section 261(1) of the Housing Act 2004.

(2)

So far as section 225 of the Housing Act 2004 confers power to make regulations, it came into force on the passing of that Act by virtue of section 270(2)(b).
