Coming into force

The Secretary of State, in exercise of the powers conferred upon him by section 15(2) of the Radioactive Substances Act 19931, makes the following Order:

Citation, commencement, cessation and extent1

This Order may be cited as the Radioactive Substances (Emergency Exemption) (England and Wales) Order 2006; it comes into force on 30th November 2006 and ceases to have effect on 26th May 2007.

This Order extends to England and Wales.

Exemption from authorisation2

Radioactive waste relating to the death of Alexander Litvinenko is excluded from the provisions of sections 13 and 14 of the Radioactive Substances Act 1993.

All other provisions of that Act apply to any person who disposes of or accumulates radioactive waste covered by this Order as they apply to persons holding an authorisation under those sections.

EXPLANATORY NOTE

(This note is not part of the Order)

Under this Order radioactive waste relating to the death of Alexander Litvinenko is excluded from the provisions of sections 13 and 14 of the Radioactive Substances Act 1993 (c.12). Those sections require a person to obtain an authorisation from the Environment Agency concerning the disposal and accumulation of radioactive waste. This Order extends to England and Wales.
