The National Park Authorities (England) Order 2006

Coming into force

The Secretary of State makes this Order in exercise of the powers conferred upon him by sections 63(1) and (5), 75(3) and (4) of, and paragraphs 1(2) to (6) and 2(1) to (3) of Schedule 7 to, the Environment Act 19951.

He has consulted the council for every principal area the whole or any part of which is comprised in a National Park in England other than the New Forest National Park as required by paragraph 2(3) of that Schedule.

Citation and commencement1

This Order may be cited as the National Park Authorities (England) Order 2006 and comes into force on 8th May 2007.

Amendment of the National Park Authorities (England) Order 19962

The National Park Authorities (England) Order 19962 is amended as follows—

a

for Schedule 1 (membership of National Park authorities) substitute the text set out in the Schedule to this Order; and

b

in paragraph 10 (disposal of abandoned vehicles) of Schedule 5 (application of enactments and instruments), for “regulation 12(1)” substitute “regulation 12(1)(e)”.

Amendment of the New Forest National Park Authority (Establishment) Order 20053

In paragraph 9 (disposal of abandoned vehicles) of Schedule 3 (application of enactments and instruments) of the New Forest National Park Authority (Establishment) Order 20053, for “regulation 12(1)(aa)” substitute “paragraph (aa) of regulation 12(1)(e)”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the National Park Authorities (England) Order 1996 (S.I. 1996/1243) so as to alter the number of members appointed to the National Park authorities for each of the National Parks in England other than Northumberland and the New Forest.

The total membership of the Peak District National Park Authority is reduced from 38 to 30, and that of each of the other authorities is reduced from 26 to 22. Changes are made, in the case of each authority, to the numbers of members appointed by the Secretary of State and by local authorities.

The opportunity is also taken to correct a reference in that Order, and a similar one in the New Forest National Park Authority (Establishment) Order 2005 (S.I. 2005/421), to a provision in the Removal and Disposal of Vehicles Regulations 1986 (S.I. 1986/183).

A regulatory impact assessment has not been prepared for this instrument as it has no impact on the costs of business.
