It gives effect in these overseas territories to Council Common Position 2005/792/CFSP adopted by the Council of the European Union on 14th November 2005 which prohibits (a) the delivery or supply of arms and related material to Uzbekistan, from Members States' territories, by their nationals, or using their flagged vessels and aircraft; (b) the provision of technical assistance, brokering services and other services related to military activities and to the provision, manufacture, maintenance and use of arms and related material to any person, entity or body in, or for use in Uzbekistan; or</p></content></level><level class="para1" eId="article-6-2-b"><num>(b)</num><content><p>a body incorporated or constituted under the law of the Territory.</p></content></level></paragraph><paragraph eId="article-6-3"><num>(3)</num><intro><p>If any ship, aircraft or vehicle is used in contravention of paragraph (1) then —</p></intro><level class="para1" eId="article-6-3-a"><num>(a)</num><content><p>in the case of a ship registered in the Territory or any aircraft so registered, the owner and the master of the ship or, as the case may be, the operator and the commander of the aircraft; or</p></content></level><level class="para1" eId="article-6-3-b"><num>(b)</num><content><p>in the case of any other ship or aircraft, the person to whom the ship or aircraft is for the time being chartered and, if he is such a person as is referred to in paragraph (2)(a) or (b), the master of the ship or, as the case may be, the operator and the commander of the aircraft; or</p></content></level><level class="para1" eId="article-6-3-c"><num>(c)</num><content><p>in the case of a vehicle, the operator of the vehicle shall be guilty of an offence under this Order, unless he proves that he did not know and had no reason to suppose that the carriage of the goods in question was, or formed part of, carriage from any place outside Uzbekistan to any destination therein.</p></content></level></paragraph><paragraph eId="article-6-4"><num>(4)</num><content><p>Nothing in paragraph (1) shall apply when the supply or delivery or exportation from the Territory of the goods concerned to Uzbekistan was authorised by a licence granted by the Governor under article 3 or 4.</p></content></paragraph><paragraph eId="article-6-5"><num>(5)</num><content><p>Nothing in this article shall be construed so as to prejudice any other provision of law prohibiting or restricting the use of ships, aircraft or vehicles.</p></content></paragraph></article></part></body></act></akomaNtoso>
