The Secretary of State for Health makes the following Order in exercise of the powers conferred on her by sections 92(6) and 126(4) of the National Health Service Act 1977(1). It appears to her that the functions of the Special Trustees for the Queen’s Medical Centre, Nottingham, University Hospital National Health Service Trust should be discharged by the trustees for Nottingham University Hospitals National Health Service Trust(2) and the Special Trustees and the new trustees have been consulted in accordance with the said section 92(6).

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Special Trustees for the Queen’s Medical Centre, Nottingham, University Hospital National Health Service Trust (Transfer of Trust Property) Order 2006 and shall come into force on 6th November 2006.

(2) In this Order—

“the Special Trustees” means the Special Trustees for the Queen’s Medical Centre, Nottingham, University Hospital National Health Service Trust;

“the new trustees” means the trustees for the Nottingham University Hospitals National Health Service Trust; and

“the trust property” means the property specified in the schedule of trust property prepared and agreed by the Special Trustees and the new trustees and signed on behalf of the Special Trustees and the new trustees on 26th September 2006.

Transfer of trust property

2.—(1) On the date that this Order comes into force the trust property, and any rights and liabilities arising from that property, shall be transferred from the Special Trustees to the new trustees.

(2) In any instrument relating to the trust property, any reference to the name by which the trustees of the trust property are to be known shall be construed as a reference to the new trustees and any reference to the Special Trustees in the name by which the charitable trust governing the trust property is to be known shall be construed as a reference to the new trustees.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order transfers trust property held by the Special Trustees for the Queen’s Medical Centre, Nottingham, University Hospital National Health Service Trust to the trustees established for the Nottingham University Hospitals National Health Service Trust and makes related provision. A copy of the schedule of trust property transferred under this Order can be obtained from the Department of Health, Quarry House, Quarry Hill, Leeds LS2 7UE.

1977 c.49 (“the 1977 Act”); section 92 was amended by section 11(5) of the National Health Service and Community Care Act 1990 (c.19) (“the 1990 Act”), by paragraph 44 of Schedule 1 to the Health Authorities Act 1995 (c.17) and by paragraph 28 of Schedule 4 to the Health Act 1999 (c.8), (“the 1999 Act”); section 126(4) has been amended by section 65(2) of the 1990 Act, section 65(1) of, and paragraphs 4 and 37 of Schedule 4 to, the 1999 Act, section 67(1) of, and paragraph 5 and 13 of Part 1 of Schedule 5 to, the Health and Social Care Act 2001 (c.15), sections 6(3)(c) and 37(1) of the National Health Service Reform and Health Care Professions Act 2002 (c.17) and sections 184 and 196 of, and paragraphs 7 and 38 of Schedule 11 to, and Part 4 of Schedule 14 to the Health and Social Care (Community Health and Standards) Act 2003 (c.43).

See S.I. 2006/1741 which provides for the appointment of trustees for the Nottingham University Hospitals National Health Service Trust for the purpose of exercising functions described in section 11(1) of the 1990 Act.
