These Regulations, which are made under section 2(2) of the European Communities Act 1972, implement in England and Wales Regulation (EC) No. 2003/2003 of the European Parliament and the Council relating to fertilisers (“the Community Regulation”).
PART 6Disapplication of legislation
Disapplication of offence provisions21
Where an act or omission is an offence under these Regulations it shall not be an offence under Part IV of the Agriculture Act 19704 or the Fertilisers Regulations 19915.
