The Race Relations Act 1976 (General Statutory Duty) Order 2006

Coming into force

The Secretary of State, in exercise of the power conferred by section 71(5) of the Race Relations Act 19761, considering that the exercise of the power relates to persons who exercise functions of a public nature, makes the following Order:

Citation and commencement1

This Order may be cited as the Race Relations Act 1976 (General Statutory Duty) Order 2006 and shall come into force on 3rd October 2006.

Amendment of Schedule 1A to the Race Relations Act 19762

Schedule 1A to the Race Relations Act 19762 is amended as follows:

a

in Part 1, under the sub-heading “Other housing bodies”, omit the entry “Scottish Homes.”;

b

in Part 2, under the sub-heading “Libraries, museums and arts”, omit the entry “The Royal Fine Art Commission for Scotland.”;

c

in Part 3, under the sub-heading “Other Bodies etc.”, omit the entry “The Pensions Compensation Board.”;

d

in Part 4, under the sub-heading “Other Bodies etc”, omit the entry “Bòrd na Gàidhlig (Alba)”; and

e

after Part 4, insert the headings and entries set out in the Schedule to this Order.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends Schedule 1A to the Race Relations Act 1976 (c.74) which lists the persons and bodies who, by virtue of section 71(1) of that Act, are subject to the general duty to have due regard, when exercising their functions, to the need to eliminate unlawful racial discrimination and to promote equality of opportunity and good relations between persons of different racial groups.

This Order omits from Parts 1 to 4 of Schedule 1A, the entries for Scottish Homes, the Royal Fine Art Commission for Scotland, the Pensions Compensation Board and Bòrd na Gàidhlig (Alba) and adds a new Part 5, set out in the Schedule to this Order, which specifies other persons and bodies to which the general duty applies.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
