The Gangmasters (Licensing) Act 2004 (Commencement No.3) Order 2006

The Secretary of State, in exercise of the powers conferred upon him by sections 29(1) and (2) of the Gangmasters (Licensing) Act 2004(1) makes the following Order:

Citation

1.  This Order may be cited as the Gangmasters (Licensing) Act 2004 (Commencement No.3) Order 2006.

Provisions coming into force

2.  The following provisions of the Gangmasters (Licensing) Act 2004 come into force on 1st October 2006—

(a)section 6(1) (prohibition of unlicensed activities) for purposes related to work falling within section 3(1)(a) and (c).

(b)section 11 (register of licences);

(c)section 12 (offences: acting as a gangmaster, being in possession of false documents etc) for purposes related to work falling within section 3(1)(a) and (c);

(d)section 13(3) (power to make regulations as to what constitutes “reasonable steps”);

(e)section 14 (offences: supplementary provisions);

(f)section 27 (exclusion of provisions relating to employment agencies and businesses) for purposes related to work falling within section 3(1)(a) and (c);

(g)section 28 (application of Act to Northern Ireland) in so far as it relates to paragraphs 12, 13, 14 and 20 of Schedule 2;

(h)paragraphs 12, 13 and 14 of Schedule 2;

(i)paragraph 20 of Schedule 2 for purposes related to work falling within section 3(1)(a) and (c).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force the provisions of the Gangmasters (Licensing) Act 2004 specified in article 2 of the Order.

Sections 6(1) and 12 are in force in respect of agricultural work and processing or packaging. Offences in relation to gathering shellfish will be commenced at a later date.
