The Secretary of State makes the following Order in exercise of the powers conferred by sections 1, 2, 3, 4, 5 and 7 of the Export Control Act 2002(1):

1.  This Order may be cited as the Export Control (Amendment) Order 2006 and shall come into force on the 23rd August 2006.

2.  In this Order—

“the 2003 Order” means the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 2003(2); and

“the Trade Order” means the Trade in Goods (Control) Order 2003(3).

3.  In paragraph 1A of article 3 of the 2003 Order after the words “are prohibited to be exported to any Member State” add “or any of the Channel Islands”.

4.  In paragraph 11(b)(iii) of article 11 of the 2003 Order insert at the end “, or from a Member State to any of the Channel Islands or from any of the Channel Islands to a Member State”.

5.  In paragraph 9(a) of article 21 of the 2003 Order delete the words “as it applies to any person who is concerned (in whatever capacity) in the exportation of goods for which an entry is required by or under that Act”.

6.  In paragraph (4A)(a) of article 3 of the Trade Order insert at the end “, or from a Member State to any of the Channel Islands or from any of the Channel Islands to a Member State”.

7.  In paragraph (4A) of article 4 of the Trade Order insert at the end “, or from a Member State to any of the Channel Islands or from any of the Channel Islands to a Member State”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order corrects amendments made to the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 2003 (‘the 2003 Order’) and the Trade in Goods (Control) Order 2003 (‘the Trade Order’) by the Export Control (Security and Para-Military Goods) Order 2006 (S.I. 2006/1696).

Articles 3 and 4 amend the 2003 Order to provide that goods of a description in Schedule 1A to that Order are prohibited to be exported to any of the Channel Islands and to provide for a control on transit to and from any of the Channel Islands. Article 5 removes unnecessary wording from article 21 of the 2003 Order.

Articles 6 and 7 amend articles 3 and 4 of the Trade Order so the controls therein will not apply to the removal of certain goods from a Member State to the Channel Islands or from the Channel Islands to a Member State.

A regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
