The Secretary of State, in exercise of the powers conferred by sections 149(1), (3), (11) and (13) of the Local Government, Planning and Land Act 19801, makes the following Order:
Citation and commencement1

This Order may be cited as the London Thames Gateway Development Corporation (Planning Functions) (Amendment) Order 2006.

This Order shall come into force on 7th September 2006.
Amendment of Order2
The London Thames Gateway Development Corporation (Planning Functions) Order 20052 is amended as follows.
Amendment relating to planning functions area3
For article 3 substitute—

The planning functions area is the development area excluding the areas shaded grey on the maps.

In paragraph (1), “the maps” means the set of maps numbered 1 and 2 entitled “Map referred to in the London Thames Gateway Development Corporation (Planning Functions) (Amendment) Order 2006”, of which prints, signed by a Director in the Department for Communities and Local Government, are deposited and available for inspection at the offices of the Secretary of State, of the development corporation and of the London Boroughs of Barking and Dagenham, Hackney, Havering, Newham and Tower Hamlets.

The London Thames Gateway Development Corporation (the corporation) was established by the London Thames Gateway Development Corporation (Area and Constitution) Order 2004 (S.I.2004/1642) for the purpose of regenerating the London Thames Gateway urban development area.
The London Thames Gateway Development Corporation (Planning Functions) Order 2005 (S.I.2005/2721) described, with the use of maps, the portions of the urban development area in which that Order conferred planning functions on the development corporation (“the planning functions areas”) (article 3). This Order amends the portions of the urban development area in which that Order conferred planning functions and replaces those maps. This is to ensure there is no overlap with the area for which the Olympic Delivery Authority will be the local planning authority by virtue of the Olympic Delivery Authority (Planning Functions) Order 2006 (S.I. 2006/2185.
Prints of the maps referred to in article 3 of this Order are available for inspection at all reasonable hours in the Library of the Department for Communities and Local Government, Ashdown House, 123 Victoria Street, London SW1E 6HE. The maps are also available at the offices of the London Borough of Barking, Planning and Transportation Department, Municipal Offices, 127 Ripple Road, Barking, IG11 7PB; the London Borough of Hackney, Planning Department, Dorothy Hodgkin House, 12 Reading Lane, London, E8 1HJ; the London Borough of Havering, Planning Department, Mercury House, Mercury Gardens, Romford, RM1 3SL; the London Borough of Newham, Development Control, Town Hall Annexe, Barking Road, East Ham, London E6 6EH; the London Borough of Tower Hamlets, Planning Department, Town Hall, Mulberry Place, 5 Clove Crescent, London, E14 2BG.
A regulatory impact assessment was prepared in relation to the London Thames Gateway Development Corporation (Area and Constitution) Order 2004 and is available on the internet at www.communities.gov.uk. Alternatively copies can be obtained from the Department for Communities and Local Government, Zone 4/J9, Eland House, Bressenden Place, London, SW1E 5DU. An additional regulatory impact assessment has not been prepared for this instrument as it has no additional impact on business, charity or voluntary bodies.
