The Secretary of State, in the exercise of the powers conferred on him by section 3C(6) of the Immigration Act 19711, makes the following Regulations:
Citation and Commencement1
These Regulations may be cited as the Immigration (Continuation of Leave) (Notices) Regulations 2006 and shall come into force on 31st August 2006.
Decision on an application for variation of leave2
For the purpose of section 3C of the Immigration Act 1971 an application for variation of leave is decided—
a
when notice of the decision has been given in accordance with regulations made under section 105 of the Nationality, Immigration and Asylum Act 20022; or where no such notice is required,
b
when notice of the decision has been given in accordance with section 4(1) of the Immigration Act 1971.
