Certificate of registration and registrable interests

The certificate of registration of a design shall include—

a

the name of the registered proprietor;

b

the date of registration; and

c

the registration number of the design.

Any request by the registered proprietor for a copy of the certificate of registration shall—

a

be in writing; and

b

be accompanied by the prescribed fee.

Before considering the request, the registrar may require the person making the request to provide such information or evidence as the registrar thinks fit.

Registration of interests27

The following matters are prescribed for the purposes of section 17(1)(c)—

a

the registered proprietor’s address for service;

b

the grant or cancellation of a licence under a registered design;

c

the granting or cancelling of a security interest (whether fixed or floating) over a registered design or any right in or under it;

d

an order of a court or other competent authority transferring a registered design or any right in or under it.

An application to the registrar to enter in the register a matter not mentioned in section 17(1)(a) or (b) or paragraph (1) shall be made in writing.

An application under section 19(1) or (2) shall be made on Form DF12A.

Where the registrar has doubts about whether he should enter a matter in the register—

a

he shall inform the person making the application of the reasons for his doubts; and

b

he may require that person to furnish evidence in support of the application.
