Freezing of funds, financial assets or economic resources or making them available to any listed person

3.  Any person who, except under the authority of a licence granted by the Governor under this article:

(1) deals with funds, financial assets or economic resources owned, held or controlled by a listed person, or

(2) makes any funds, financial assets or economic resources available, directly or indirectly, to or for the benefit of any listed person,

shall be guilty of an offence under this Order:

Provided that in any proceedings for an offence under this article, it is a defence for a person to show that he did not know and had no reasonable cause to suspect, as the case may be, that he was dealing with funds, financial assets or economic resources owned, held or controlled by a listed person, or that he was making funds, financial assets or economic resources available, directly or indirectly, to or for the benefit of a listed person;

  • Provided further that a person or a relevant institution is not guilty of an offence under this article or article 4 if he or it credits an account of a listed person with interest or other earnings on the account, or in the case of a relevant institution, with funds transferred from a third party, provided the institution informs the Governor without delay.
