The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 30DD(1)(c), 89(1), (1A) and (2), 122(1) and 175(1), (3) and (4) of the Social Security Contributions and Benefits Act 1992 and sections 4(1)(b), 35(1) and 36(1) to (4) of the Jobseekers Act 1995.

The Social Security Advisory Committee has agreed that the proposals in respect of these Regulations should not be referred to it. 1992 c. 4. Section 30DD was inserted by section 63 of the Welfare Reform and Pensions Act 1999 (c. 30) and subsection (1) was substituted by S.I. 2006/343. Section 89(1) was amended by paragraph 26 of Schedule 1 to the Social Security (Incapacity for Work) Act 1994 (c. 18) and Schedule 6 to the Tax Credits Act 2002 (c. 21) and subsection (1A) was inserted, and subsection (2) was amended, by S.I. 2006/343. Section 175(1) and (4) was amended by paragraph 29(2) and (4) of Schedule 3 to the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (c. 2). Section 122(1) is cited because of the meaning there given to the words “prescribe” and “regulations”. 1995 c. 18. Section 4(1)(b) was amended by S.I. 2006/343. Section 35(1) was amended by paragraph 62 of Schedule 3 to the Social Security Contributions (Transfer of Functions, etc.) Act 1999. Section 36(1) was amended by paragraph 145 of Schedule 7 to the Social Security Act 1998 (c. 14) and paragraph 29(6) of Schedule 8 to the Welfare Reform and Pensions Act 1999, and subsection (4) was amended by paragraph 63 of Schedule 3 to the Social Security Contributions (Transfer of Functions, etc.) Act 1999. Section 35(1) is cited because of the meaning there given to the words “prescribed” and “regulations”. See sections 170, 172(1) and 173(1)(b) of the Social Security Administration Act 1992 (c. 5). Paragraph 67 of Schedule 2 to the Jobseekers Act 1995 added that Act to the list of “relevant enactments” in section 170(5) of the Social Security Administration Act 1992 in respect of which regulations must normally be referred to the Committee.
