PART 2DISCRIMINATION IN EMPLOYMENT AND VOCATIONAL TRAINING

Assisting persons to obtain employment etc

22.—(1) It is unlawful for the Secretary of State to discriminate against any person by subjecting him to a detriment, or to subject a person to harassment, in the provision of facilities or services under section 2 of the Employment and Training Act 1973(1) (arrangements for assisting persons to obtain employment).

(2) It is unlawful for Scottish Enterprise or Highlands and Islands Enterprise to discriminate against any person by subjecting him to a detriment, or to subject a person to harassment, in the provision of facilities or services under such arrangements as are mentioned in section 2(3) of the Enterprise and New Towns (Scotland) Act 1990(2) (arrangements analogous to arrangements in pursuance of the said Act of 1973).

(3) This regulation does not apply in a case where—

(a)regulation 20 (the provision of vocational training) applies or would apply but for the operation of any other provision of these Regulations, or

(b)the Secretary of State is acting as an employment agency within the meaning of regulation 21 (employment agencies, careers guidance etc).
