The Private Security Industry Act 2001 (Commencement No. 8) (Amendment) Order 2005

The Secretary of State, in exercise of the powers conferred upon him by section 26(2) of the Private Security Industry Act 2001(1), having consulted the Security Industry Authority in accordance with section 24(4) of that Act, hereby makes the following Order:

Title and commencement

1.  This Order may be cited as the Private Security Industry Act 2001 (Commencement No. 8) (Amendment) Order 2005 and shall come into force on 27th February 2005.

2.  Articles 2(c) and 4 of the Private Security Industry Act 2001 (Commencement No. 8) Order 2005(2) are hereby revoked.

Explanatory Note

(This note is not part of the Order)

Article 2(c) of the Private Security Industry Act 2001 (Commencement No. 8) Order 2005 (“the 2005 Order”) brings section 6 of the 2001 Act (offence of using unlicensed wheel-clampers) into force in England and Wales on 28th February 2005. Article 4 of the 2005 Order brings into force section 3(2)(a) to (i) of the 2001 Act (conduct prohibited without a licence) in the metropolitan police district and the City of London police area only in respect of the activities of wheel clamping and the blocking in and towing away of vehicles. This Order revokes these two articles. Section 3(2)(a) to (i) of the 2001 Act will be brought into force in the metropolitan police district and the City of London police area on 11th April 2005 by the 2005 Order. Section 6 of the 2001 Act will be brought into force at a later date by a separate commencement order.
