The Nursing and Midwifery Council has made the Nursing and Midwifery Council (Fees) (Amendment) Rules 2005 as set out in the Schedule to this Order.

In accordance with articles 47(1) and 48 of the Nursing and Midwifery Order 2001(1) such Rules shall not come into force until approved by order of the Privy Council.

Having considered the Rules, their Lordships approve them.

This Order may be cited as the Nursing and Midwifery Council (Fees) (Amendment) Rules Order of Council 2005 and shall come into force on 1st January 2006.

SCHEDULETHE NURSING AND MIDWIFERY COUNCIL (FEES) (AMENDMENT) RULES 2005

The Nursing and Midwifery Council makes the following Rules in exercise of its powers conferred under articles 7(1) and (2), 33(7)(a) and 47(2) of the Nursing and Midwifery Order 2001(2).

The Nursing and Midwifery Council has consulted in accordance with articles 7(3) and 47(3) of that Order.

Citation and Commencement

1.  These Rules may be cited as the Nursing and Midwifery Council (Fees) (Amendment) Rules 2005 and shall come into force on 1st January 2006.

Interpretation

2.  In these Rules “the principal Rules” means the Nursing and Midwifery Council (Fees) Rules 2004(3).

Amendments to the principal Rules

3.  In rule 3 of the principal Rules (fees)—

(a)for the words “or evaluation” substitute “, an evaluation or a retention”;

(b)in the table—

(i)omit row (a);

(ii)in the entry in column (2) of row (b), omit the words “other than one to which (a) above applies,”;

(iii)in the entry in column (3) of row (b), for “£129” substitute “£43”;

(iv)in the entry in column (3) of row (c), for “£162” substitute “£76”;

(v)in the entry in column (3) of row (e), for “£129” substitute “£43”;

(vi)in the entry in column (3) of row (f), for “£129” substitute “£43”;

(vii)in the entry in column (2) of row (g), for the words “(a) to” substitute “(b),”; and

(viii)after row (h), add row (i)—

(i)a retention of registration£43.

4.  After rule 3 of the principal Rules (fees) add—

Fee for retention of registration

4.(1) In respect of any registration period beginning on or after 1st January 2006, the registrant shall, except as provided for in paragraph (2), pay a fee for retention of registration (as prescribed in rule 3(i)) which shall be due—

(a)where the registration period is a first registration period (determined in accordance with rule 10 of the Nursing and Midwifery Council (Education, Registration and Registration Appeals) Rules 2004(4)), on the first and second anniversary of the last day of the month of registration; and

(b)where the registration period is subsequent to a first registration period (determined in accordance with rule 10 of those Rules), on the first and second anniversary of the day on which her previous registration period ended.

(2) Where a registrant’s registration period ends on 31st December 2005 a fee for retention of registration will not be due during the registration period ending 31st December 2008..

Explanatory Note

(This note is not part of the Order)

This Order, which is made under the Nursing and Midwifery Order 2001, approves Rules made by the Nursing and Midwifery Council which amend the Nursing and Midwifery Council (Fees) Rules 2004.

Rules 3 makes various adjustments to the fees to be paid in connection with applications for inclusion in the register.

Rule 4 provides that in each three year registration period which begins on or after 1st January 2006 (other than one which ended on 31st December 2005) a registrant will be required to pay a fee for retention of registration at the end of the first and second years of each three year registration period. A registrant will still be required to pay a renewal fee at the end of a registration period if she wishes her registration to be renewed.
