Coming into force
The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 6 and 60 of the Public Passenger Vehicles Act 19811 and by section 41(1) of the Road Traffic Act 19882.
In accordance with section 61(2) of the Public Passenger Vehicles Act 1981 and section 195(2) of Road Traffic Act 1988 he has consulted such representative organisations as he thinks fit.
Citation and commencement1
These Regulations may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) (No.3) Regulations 2005 and shall come into force on 12th December 2005.
Modification of the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations2
After regulation 4, in Part II, of the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 19813 there shall be added—
Alternative prescribed conditions4A
The prescribed conditions as to the fitness of a vehicle contained in Part II may alternatively be met by a vehicle satisfying the requirements in such of the Annexes to Directive 2001/85/EC of the European Parliament and of the Council of 20 November 2001, relating to special provisions for vehicles used for the carriage of passengers comprising more than eight seats in addition to the drivers seat, and amending Directives 70/156/EEC and 97/27/EC4, as apply to it.
