The Secretary of State, in exercise of the powers conferred by section 144(3)(b) and (14) of the Transport Act 2000(1), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005 and shall come into force on 1st November 2005.

Approved local authorities

2.  Each authority listed in column (1) of the Schedule to this Order, whose area is wholly or partially designated by order under paragraphs 1(1) and 2(1) of Schedule 3 to the Road Traffic Act 1991(2) (permitted and special parking areas outside London)(3), of which the reference number is given in column (2) of the Schedule, is an approved local authority for the purposes of section 144 of the Transport Act 2000 (civil penalties for bus lane contraventions).

Explanatory Note

(This note is not part of the Order)

The Bus Lane Contraventions (Penalty Charges, Adjudication and Enforcement) (England) Regulations 2005 (S.I. 2005/2757) made under section 144 of the Transport Act 2000 provide for the enforcement of bus lane restrictions through the imposition, by approved local authorities, of penalty charges in respect of contraventions of such restrictions. This Order specifies the authorities listed in column (1) of the Schedule as approved local authorities for the purposes of section 144.

No Regulatory Impact Assessment has been undertaken, since the Order is concerned with the enforcement of existing traffic restrictions and prohibitions and does not therefore constitute an additional burden on business. The costs incurred by local authorities undertaking enforcement are expected to be defrayed by penalty charge income.
