The Children Act 2004 (Designation of NHS Direct) Order 2005

The Secretary of State for Education and Skills, in exercise of the powers conferred upon her by section 11(1)(d) of the Children Act 20041, hereby makes the following Order:–

Citation and commencement1.

This Order may be cited as the Children Act 2004 (Designation of NHS Direct) Order 2005 and shall come into force on 1st October 2005.

Designation of NHS Direct2.

NHS Direct2, being a Special Health Authority exercising functions in relation to England, is hereby designated for the purposes of section 11(1)(d) of the Children Act 2004.

Section 11 of the Children Act 2004 places a duty on the persons and bodies mentioned in subsection (1) of that section to make arrangements to ensure that their functions are discharged having regard to the need to safeguard and promote the welfare of children. Section 11(1)(d) refers to a Special Health Authority, so far as exercising functions in relation to England, designated by order made by the Secretary of State. This order designates NHS Direct for that purpose.
