9. In section 23(4) of the Health and Safety at Work etc. Act 1974(1) (supplementary provisions about notices) for the words from “has the meaning” to the end substitute the following—
“, in relation to premises, means—
where the Regulatory Reform (Fire Safety) Order 2005 applies to the premises, the enforcing authority within the meaning given by article 25 of that Order;
in any other case, the fire and rescue authority under the Fire and Rescue Services Act 2004 for the area where the premises are (or are to be) situated.”.
1974 (c. 37). Section 23(4) was amended by the Fire and Rescue Services Act 2004 (c. 21), section 53(1) and paragraph 44 of Schedule 1.
