The Secretary of State, in exercise of the powers conferred upon her by sections 43B(1) and 43C(3) of the National Lottery etc. Act 1993(1), and having consulted such persons as appears to her to be appropriate in accordance with section 43C(4) of that Act, hereby makes the following Order, a draft of which has been laid before Parliament in accordance with section 60(2)(2) of that Act and approved by a resolution of each House of Parliament:
1. This Order may be cited as the New Opportunities Fund (Specification of Initiative) Order 2005 and shall come into force on the day after the day on which it is made.
2. An initiative (to be implemented in conjunction with another body, or other bodies, distributing money under section 25(1) of the National Lottery etc. Act 1993) to make grants (to be known as Transformational Grants) concerned or connected with health, education or the environment; and intended to transform communities, regions or the nation as a whole is specified for the purposes of section 43B(1) of the National Lottery etc. Act 1993.

This Order specifies an initiative concerned or connected with health, education or the environment and accordingly allows the New Opportunities Fund to make grants, or make or enter into arrangements, under section 43B of the National Lottery etc. Act 1993 which are designed to give effect to that initiative.
1993 c. 39. Sections 43B and 43C were inserted by section 7(2) of the National Lottery Act 1998 (c. 22).
Section 60(2) of the National Lottery etc. Act 1993 was amended, so as to include a reference to orders under section 43B of that Act, by section 15(2) of the National Lottery Act 1998. In section 60 of the 1993 Act, a reference to an order is a reference to an order of the Secretary of State: see section 60(6) which was inserted by section 15(6) of the 1998 Act.
