        </Number><Title>ACQUISITION AND POSSESSION OF LAND</Title><Pblock DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/part/3/crossheading/supplementary" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/part/3/crossheading/supplementary" NumberOfProvisions="4" RestrictStartDate="2004-04-02" id="part-3-crossheading-supplementary"><Title><Emphasis>Supplementary</Emphasis></Title><P1group RestrictStartDate="2004-04-02"><Title>Open space</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36" id="article-36"><Pnumber>36</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36/1" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36/1" id="article-36-1"><Pnumber>1</Pnumber><P2para><Text>DLRL shall not under the powers of this Order take possession of any part of the existing open space until DLRL has taken possession of so much of the replacement land as is equivalent in area to the amount of the existing open space that is required by DLRL for the authorised works.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36/2" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36/2" id="article-36-2"><Pnumber>2</Pnumber><P2para><Text>Upon DLRL’s possession of so much of the existing open space as is required for the authorised works that land shall be discharged from all rights, trusts and incidents to which it was previously subject.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36/3" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36/3" id="article-36-3"><Pnumber>3</Pnumber><P2para><Text>DLRL shall lay out as replacement open space before the authorised works are first brought into public use so much of the replacement land of which possession has been taken under paragraph (1).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36/4" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36/4" id="article-36-4"><Pnumber>4</Pnumber><P2para><Text>As soon as the Council of the London Borough of Greenwich has certified that the land referred to in paragraph (3) has been laid out to its reasonable satisfaction that land shall vest in the London Development Agency subject to the like rights, trusts and incidents as attached to so much of the existing open space of which possession has been taken under paragraph (1).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36/5" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36/5" id="article-36-5"><Pnumber>5</Pnumber><P2para><Text>In this article—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36/5/a" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36/5/a" id="article-36-5-a"><Pnumber>a</Pnumber><P3para><Text>“<Term id="term-the-existing-open-space">the existing open space</Term>” means the open space comprised in the land in the London Borough of Greenwich numbered 98 on the deposited plans and coloured red on the open space and exchange land plan; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2004/757/article/36/5/b" IdURI="http://www.legislation.gov.uk/id/uksi/2004/757/article/36/5/b" id="article-36-5-b"><Pnumber>b</Pnumber><P3para><Text>“<Term id="term-the-replacement-land">the replacement land</Term>” means the land in the London Borough of Greenwich numbered 95, 96, 99, 100 and 108 on the deposited plans and coloured green on the open space and exchange land plan.</Text></P3para></P3></P2para></P2></P1para></P1></P1group></Pblock></Part></Body></Secondary></Legislation>
