The Secretary of State for Transport makes this Scheme in exercise of powers conferred by sections 16, 17 and 19 of the Highways Act 1980(1) and now vested in him(2), and of all other powers enabling him in that behalf:

1.  This Scheme may be cited as the M62 Motorway (Junction 21 Improvements and Connecting Road) Scheme 2004 and shall come into force on 31st December 2004.

2.  In this Scheme—

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (i) “connecting road” means a special road about 675 metres in length, starting about 725 metres further west than the existing one, which connects the eastbound carriageway of the Motorway with a new roundabout junction. The special road is indicated as a thick black line on the plan;

(ii)“the Motorway” means the M62 Motorway at Milnrow near Rochdale;

(iii)“the plan” means the plan numbered HA/16/OD/26 titled “The M62 Motorway (Junction 21 Improvements and Connecting Road) Scheme 2004” signed by authority of the Secretary of State for Transport and deposited at the DTLR, Records Management Branch, Ashdown House, Sedlescombe Rd North, St Leonards-on-Sea, East Sussex TN37 7GA; and

(iv)“the special road” means the connecting road.

3.  The Secretary of State is authorised to provide the special road for the exclusive use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980.

4.  The centre line of the special road is indicated by a heavy black line on the plan.

5.  The special road shall become a trunk road on the date when this Scheme comes into force.
