The Secretary of State, in exercise of the powers in sections 3(1), (2) and (4) and 4(1) of the Plant Health Act 1967(1), and now vested in her(2), and the Forestry Commissioners, in exercise of the powers conferred on them by those sections, hereby make the following Order:

1967 c. 8; section 3(1) and (2) were amended by the European Communities Act 1972 (c. 68), section 4(1) and Schedule 4, paragraph 8; section 3(4) was substituted by section 42 of the Criminal Justice Act 1982 (c. 48) and further amended by section 17(1) of the Criminal Justice Act 1991 (c. 53). Section 1(2) of the Plant Health Act 1967 defines “competent authorities” for the purposes of the Act.

Under article 2(1) and (2) of the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794) the functions of the Minister of Agriculture, Fisheries and Food under the Plant Health Act 1967 as regards England were transferred to the Secretary of State.
