In exercise of the powers conferred upon the Secretary of State by sections 19 and 54(3) of the Education Act 1997(1), the Secretary of State for Education and Skills hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Education (School Performance Targets) (England) (Amendment) Regulations 2004 and shall come into force on 22nd December 2004.
(2) These Regulations apply only in relation to schools in England.
2. The Education (School Performance Targets) (England) Regulations(2) shall be amended in accordance with regulation 3.
3. At the end of regulation 4(2) insert the words “in connection with the performance of the relevant group of third key stage pupils in NC tests or teacher assessments to be administered at or near the end of the following school year”.

These Regulations are made to correct a defect in the Education (School Performance Targets) (England) Regulations 2004 (SI 2004/2858).
These Regulations amend the earlier Regulations by inserting words erroneously omitted from regulation 4(2). The words make clear that targets in respect of pupils taking the Key Stage 3 National Curriculum tests and teacher assessments are to be set by schools in the school year before the pupils are due to take the tests.
These Regulations will be issued free of charge to all known recipients of S.I. 2004/2858.
