The First Secretary of State, in exercise of the powers conferred by section 167(1) of the Commonhold and Leasehold Reform Act 20021, hereby makes the following Regulations, of which a draft has been laid before, and approved by resolution of, each House of Parliament:
Citation, commencement and application1

These Regulations may be cited as the Rights of Re-entry and Forfeiture (Prescribed Sum and Period) (England) Regulations 2004 and shall come into force on the day after that on which they are made.

These Regulations apply in relation to dwellings in England that are occupied under a long lease2.
Prescribed sum and period2

The sum prescribed for the purposes of subsection (1)(a) of section 167 (failure to pay small amount for short period) of the Commonhold and Leasehold Reform Act 2002 is £350.

The period prescribed for the purposes of subsection (1)(b) of that section is three years.
