Coming into force

The Secretary of State for Health, in exercise of the powers conferred on him by section 22(1) and (2) of the Health and Social Care (Community Health and Standards) Act 20031, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation1

This Order may be cited as the Cambridge University Hospitals National Health Service Foundation Trust (Trust Funds: Appointment of Trustees) Order 2004 and shall come into force on 30th September 2004.

In this Order—

  • the Act” means the Health and Social Care (Community Health and Standards) Act 2003; and

  • “the Trust” means the Cambridge University Hospitals National Health Service Foundation Trust2.

Appointment of trustees2

The Secretary of State shall appoint trustees for the Trust for the purpose of exercising the functions described in section 22(1) of the Act (trust funds and trustees).

The appointment of any such trustee shall be for such period, not exceeding 4 years, as the Secretary of State may specify on making the appointment.

Termination and suspension of appointment3

Where the Secretary of State is of the opinion that it is not in the interests of the Trust or the health service that a trustee for the Trust should continue to hold that office, he may forthwith terminate the appointment and, pending his decision, may suspend any such trustee from such office.

This Order provides for the Secretary of State for Health to appoint trustees for the Cambridge University Hospitals National Health Service Foundation Trust to hold trust property for the purposes of the trust or for any other purpose relating to the NHS, and for their removal from office.
