40.—(1) Amend section 31 (rules of court) as follows.

(2) In subsection (1)—

(a) for “Rules of court” substitute “Criminal Procedure Rules”, and

(b) for “authority making them” substitute “Criminal Procedure Rule Committee”.

(3) Omit subsection (2).
