At the Court at Buckingham Palace, the 27th day of July 2004
Present,
The Queen’s Most Excellent Majesty in Council
Her Majesty, in exercise of the powers conferred on Her by section 96 of the Criminal Justice Act 1988(1) is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—
1.—(1) This Order may be cited as the Criminal Justice Act 1988 (Designated Countries and Territories) (Amendment) Order 2004 and shall come into force on 29th July 2004.
(2) This Order extends to England and Wales only.
2. There shall be inserted in Schedule 1 to the Criminal Justice (Designated Countries and Territories) Order 1991(2) (designation of countries and territories for the purposes of sections 96 and 97 of the Criminal Justice Act 1988), at the appropriate place in alphabetical order, the following entry —
| “Designated country | Appropriate authority |
|---|---|
| South Africa” |
A. K. Galloway
Clerk of the Privy Council
(This note is not part of the Order)
This Order amends the Criminal Justice Act 1988 (Designated Countries and Territories) Order 1991 to add South Africa to the list of countries and territories in Schedule 1 to that Order.
1988 c. 33; section 96 was amended by section 21 of the Criminal Justice Act 1993 (c. 36). Sections 71 to 102 of the Criminal Justice Act 1988 were repealed by Schedule 12 to the Proceeds of Crime Act 2002 (c. 29) but the repeal of section 96 is not in force and there is a saving for the provisions of the Criminal Justice Act 1988 in respect of the Criminal Justice Act 1988 (Designated Countries and Territories) Order 1991 in article 13(a) of the Proceeds of Crime Act 2002 (Commencement No. 5, Transitional Provisions, Savings and Amendment) Order 2003 (S.I. 2003/333 (C.20)).
