The Enterprise Act 2002 (Commencement No. 6) Order 2004

The Secretary of State, in exercise of the powers conferred upon her by section 279 of the Enterprise Act 20021 hereby makes the following Order:

Citation and interpretation1

This Order may be cited as the Enterprise Act 2002 (Commencement No. 6) Order 2004.

Appointed day2

The day appointed for the coming into force of paragraph 4 of Schedule 5 to the Enterprise Act 2002 for all remaining purposes is the day after the day on which this Order is made.

This Order brings into force paragraph 4 of Schedule 5 to the Enterprise Act 2002 for all remaining purposes. It therefore brings into force section 49(1)(b) of the Competition Act 1998 (as substituted by paragraph 4 of Schedule 5 to the Enterprise Act 2002). This provision provides a right of appeal against an award of damages by the Competition Appeal Tribunal (including a right of appeal against any amount awarded).

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
