The Education (National Curriculum) (Attainment Targets and Programmes of Study in Modern Foreign Languages in respect of the Third Key Stage) (England) (No.2) Order 2004
And whereas, in accordance with directions given by the Secretary of State under the said subsection (2), the QCA has submitted its report to the Secretary of State in accordance with subsection (4) of the said section 96;
And whereas the QCA has, after submitting its report to the Secretary of State, arranged for it to be published in accordance with subsection (5) of that section;
And whereas the Secretary of State has published a draft of this Order and sent copies of it to the QCA and all those who were consulted by the QCA, and has allowed a period of not less than one month for the submission of evidence and representations as to the issues arising in accordance with subsections (6) and (7) of that section;
Now therefore the Secretary of State for Education and Skills, in exercise of the powers conferred on the Secretary of State by sections 87(3)(a) and (b), 87(5) and 210 of the Education Act 2002, hereby makes with modification the following Order:
Citation, commencement, interpretation and application1.

This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study in Modern Foreign Languages in respect of the Third Key Stage) (England) (No.2) Order 2004 and shall come into force on 1st August 2004.

This Order applies only to pupils in the third key stage at–
(a)
a community, foundation or voluntary school; or
(b)
a community or foundation special school not established in a hospital,
in England.
Revocation2.
Specification of attainment targets and programmes of study3.
It is hereby directed that the provisions relating to attainment targets and programmes of study set out in the Document shall have effect for the purposes of specifying attainment targets and programmes of study in relation to modern foreign languages.
This Order provides for the attainment targets and programmes of study set out in the document published by the Department for Education and Skills and the QCA entitled Modern Foreign Languages, the National Curriculum for England, Key Stage 3 (ISBN 1 84478 151 8; order reference DfES/0120/2004) to have effect for the purposes of specifying those elements of the National Curriculum in modern foreign languages, for pupils in the third key stage at schools in England.
This Order replaces the Education (National Curriculum) (Attainment Targets and Programmes of Study in Modern Foreign Languages) (England) Order 2000 which is revoked.
This Order is made in consequence of a defect in the Education (National Curriculum) (Attainment Targets and Programmes of Study in Modern Foreign Languages in respect of the Third Key Stage) (England) Order 2004 (S.I. 2004/256) which is revoked by this Order. This Order will be issued free of charge to all known recipients of S.I. 2004/256.
