					<dc:description>These Regulations, which come into force on 1st July 2004, revoke and replace the Goods Infringing Intellectual Property Rights (Customs) Regulations 1999 (S.I. 1999/1601, amended by S.I. 2003/2316) and the Goods Infringing Intellectual Property Rights (Consequential Provisions) Regulations 1999 (S.I. 1999/1618).  Those Regulations made provisions consequential upon Council Regulation (EC) No 3295/1994 (OJ No L 341, 30.12.94, p 8), as amended by Council Regulation (EC) No 241/1999 (OJ No L 27, 2.2.99, p 1), which laid down measures concerning the entry into the Community, and the export and re-export from the Community, of goods infringing certain intellectual property rights.</dc:description>

<Text>The Commissioners of Customs and Excise, in exercise of the powers conferred on them by section 2(2) of the European Communities Act 1972<FootnoteRef Ref="f00001"/>, being a Department designated<FootnoteRef Ref="f00002"/> for the purposes of that subsection in relation to counterfeit and pirated goods, goods infringing a patent, goods infringing a supplementary protection certificate, goods infringing Community plant variety rights and goods infringing plant breeders' rights, designations of origin, geographical indications and geographical designations, hereby make the following Regulations:</Text>

Regulations may be cited as the Goods Infringing Intellectual Property Rights (Customs) Regulations 2004 and shall come into force on 1st July 2004.</Text></P1para></P1></P1group><P1group IdURI="http://www.legislation.gov.uk/id/uksi/2004/1473/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“the <Abbreviation Expansion="Customs and Excise Management Act 1979 c. 2">1979 Act</Abbreviation>” means the Customs and Excise Management Act 1979<FootnoteRef Ref="f00003"/>;</Text></Para></ListItem><ListItem><Para><Text>“application” means an application under Article 5 of the <Abbreviation Expansion="Council Regulation (EC) No 1383/2003 concerning customs action against goods suspected of infringing certain intellectual property rights and the measures to be taken against goods found to have infringed such rights">Council Regulation</Abbreviation>;</Text></Para></ListItem><ListItem><Para><Text>“<Abbreviation Expansion="the Commissioners of Customs and Excise">the Commissioners</Abbreviation>” means the Commissioners of URI="http://www.legislation.gov.uk/european/regulation/2003/1383" id="c00003" Class="EuropeanUnionRegulation" Year="2003" Number="1383">(<Acronym Expansion="European Community">EC</Acronym>) No 1383/2003</Citation> concerning customs action against goods suspected of infringing certain intellectual property rights and the measures to be taken against goods found to have infringed such rights<FootnoteRef Ref="f00006"/>;</Text></Para></ListItem><ListItem><Para><Text>“the customs and excise Acts” has the meaning given in section 1(1) of the 1979 Act;</Text></Para></ListItem><ListItem><Para><Text>“database rights” has the meaning given in regulation 13 of the Copyright and Rights in Databases Regulations 1997<FootnoteRef Ref="f00007"/>;</Text></Para></ListItem><ListItem><Para><Text>“decision” means a decision granting an application in accordance with Article 8 of the Council Regulation;</Text></Para></ListItem><ListItem><Para><Text>“declarant” has the meaning given in Article 4(18) of Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/1992/2913" id="c00004" Class="EuropeanEconomicCommunityRegulation" Year="1992" Number="2913">(<Acronym Expansion="European Economic Community">EEC</Acronym>) No 2913/1992</Citation> establishing the Community Customs Code<FootnoteRef Ref="f00008"/>;</Text></Para></ListItem><ListItem><Para><Text><CommentaryRef given in Article 3(1) of Council Regulation (EEC, Euratom) No 1182/1971 determining the rules applicable to periods, dates and time limits<FootnoteRef Regulation to “copyright or related right” is to be construed as a reference to “copyright, rights in performances, publication rights or database rights”.</Text></P2para></P2><P2 intellectual property right; but these Regulations shall not apply to any goods in relation to which the Council Regulation does not apply by virtue of  <Substitution CommentaryRef="key-d177d8d1b98fb38110572cfa784b7e57">The Commissioners may treat as abandoned for destruction goods which have been suspended from release or detained by virtue of  </Substitution><Substitution ChangeId="key-d177d8d1b98fb38110572cfa784b7e57-1491384100212" CommentaryRef="key-d177d8d1b98fb38110572cfa784b7e57"><Substitution ChangeId="key-bc80e5b8e1d2c4fd8a8375db128b2fe3-1491388054219" CommentaryRef="key-bc80e5b8e1d2c4fd8a8375db128b2fe3">Article 9 of the Council Regulation</Substitution></Substitution><Substitution ChangeId="key-d177d8d1b98fb38110572cfa784b7e57-1491384100212" CommentaryRef="key-d177d8d1b98fb38110572cfa784b7e57">  where the right-holder has informed the Commissioners in writing within the specified period that those goods infringe an intellectual property right and either of the following conditions applies—</Substitution></Text><P4 regulation 7(1)(a), but either or both of the other interested parties has specifically opposed destruction within the specified period.</Substitution></Text></P2para></P2><P2 suspend the decision in force at the time of the misuse of information, in relation to a relevant intellectual property right, for the remainder of its period of validity.</Text></P2para></P2><P2 id="regulation-11-2-b"><Pnumber>b</Pnumber><P3para><Text>for a period of up to one year from its expiry, refuse to renew the decision in force at the time of the further misuse of information, or to accept a new application, in relation to a relevant intellectual property right.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2004/1473/regulation/11/3" supplied to a right-holder pursuant to the first sub-paragraph of Article 9(3) of the Council Regulation, and in relation to which the Commissioners have reasonable grounds for believing that there has been a misuse of that information.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W+S+NI" RestrictStartDate="2004-07-01"><Title>Amendment of the Copyright, Designs and Patents Act 1988</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2004/1473/regulation/12" IdURI="http://www.legislation.gov.uk/id/uksi/2004/1473/regulation/12" <Text>These Regulations, which come into force on 1st July 2004, revoke and replace the Goods Infringing Intellectual Property Rights (Customs) Regulations 1999 (S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1601" id="c00011" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1601">1999/1601</Citation>, amended by S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/2003/2316" id="c00012" Class="UnitedKingdomStatutoryInstrument" Year="2003" Number="2316">2003/2316</Citation>) and the Goods Infringing Intellectual Property Rights (Consequential Provisions) Regulations 1999 (S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1618" id="c00013" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1618">1999/1618</Citation>).  Those Regulations made provisions consequential upon Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/1994/3295" id="c00014" Class="EuropeanUnionRegulation" Year="1994" Number="3295">(EC) No 3295/1994</Citation> (<Acronym Expansion="Official Journal">OJ</Acronym> No L 341, 30.12.94, p 8), as amended by Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/1999/0241" id="c00015" Class="EuropeanUnionRegulation" Year="1999" Number="241">(EC) No 241/1999</Citation> (OJ No L 27, 2.2.99, p 1), which laid down measures concerning the entry into the Community, and the export and re-export from the Community, of goods infringing certain intellectual property rights.</Text>

<P><Text>Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2003/1383" id="c00016" Class="EuropeanUnionRegulation" Year="2003" Number="1383">(EC) No 1383/2003</Citation> (OJ No L 196, 2.8.03, p 7), which replaces Regulation 3295/1994 with effect from 1st July 2004, introduces the following principal changes:</Text>

<Text>These Regulations re-enact regulations 2 to 8 of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1618" id="c00017" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1618">1999/1618</Citation> amended to reflect Regulation <Citation URI="http://www.legislation.gov.uk/id/uksi/1383/2003" id="c00018" Class="UnitedKingdomStatutoryInstrument" Year="1383" Number="2003">1383/2003</Citation>, make new provisions consequential upon Regulation <Citation URI="http://www.legislation.gov.uk/id/uksi/1383/2003" id="c00019" Class="UnitedKingdomStatutoryInstrument" Year="1383" Number="2003">1383/2003</Citation> and re-enact paragraphs 8(b) and (c) of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1601" id="c00020" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1601">1999/1601</Citation>.  The other provisions of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1601" id="c00021" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1601">1999/1601</Citation>, relating to the application form, the provision of security by the applicant and the application fee, are rendered otiose by the changes introduced by Regulation <Citation URI="http://www.legislation.gov.uk/id/uksi/1383/2003" id="c00022" Class="UnitedKingdomStatutoryInstrument" Year="1383" Number="2003">1383/2003</Citation>.</Text>

<Text>These Regulations revoke and replace the Trade Marks (EC Measures Relating to Counterfeit Goods) Regulations 1995 (S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1995/1444" id="c00023" Class="UnitedKingdomStatutoryInstrument" Year="1995" Number="1444">1995/1444</Citation>) which excluded goods covered by Regulation 3295/1994 from the operation of section 89 of the Trade Marks Act 1994.  These Regulations also amend section 111(3B) of the Copyright, Designs and Patents Act 1988.</Text>

<Text>These Regulations revoke the Goods Infringing Intellectual Property Rights (Customs) Regulations 2003 (S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/2003/2316" id="c00024" Class="UnitedKingdomStatutoryInstrument" Year="2003" Number="2316">2003/2316</Citation>), which abolished fees for applications to the Commissioners with effect from 1<Superior>st</Superior> October 2003 and which are now otiose.</Text>

<Text>Regulation 4 re-enacts regulation 4 of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1618" id="c00027" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1618">1999/1618</Citation>, with the addition of paragraph (1)(a) and of the reference to the declarant in paragraph (1)(b).</Text>

<Text>Regulation 5 re-enacts paragraphs 8(b) and (c) of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1601" id="c00028" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1601">1999/1601</Citation>.</Text>

<Text>Regulation 6 is a new provision setting out circumstances in which samples of suspected infringing goods may be provided to the right-holder.</Text>

<Text>Regulation 8 re-enacts regulation 6 of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/1618" id="c00029" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="1618">1999/1618</Citation>, amended to reflect the extended scope of  Regulation <Citation URI="http://www.legislation.gov.uk/id/uksi/1383/2003" id="c00030" Class="UnitedKingdomStatutoryInstrument" Year="1383" Number="2003">1383/2003</Citation> and to provide for a 3 day period where perishable goods are involved.</Text>
</P>

<Text>Regulation 11 is a new provision setting out the sanctions which the Commissioners may impose if there has been a misuse of information by a right-holder.  In all cases the Commissioners may suspend the decision in relation to a relevant intellectual property right for the remainder of its period of validity (the maximum period of validity is one year).  If the right-holder has misused information within the previous three years the Commissioners may also refuse to renew the decision, or to accept an application, in relation to a relevant intellectual property right for a period of up to one year from the date of its expiry.</Text>

<Text>Regulations 12 and 13 amend section 111(3B) of the Copyright, Designs and Patents Act 1988 and section 89(3) of the Trade Marks Act 1994 to refer to Regulation 1383/2003.</Text>
</P>

<Text>Regulation 14 revokes the four Regulations referred to above and listed in the Schedule.</Text>
</P>
<P>
<Text>A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business, charities or voluntary bodies.</Text>
