<Text>The Secretary of State, being satisfied with respect to the non-indigenous mammalian species which are the subject of this Order that by reason of their destructive habits it is desirable to prohibit or control the keeping of them and to destroy any which may be at large, in exercise of the powers conferred by section 10(1) of the Destructive Imported Animals Act 1932<FootnoteRef Ref="f00001"/> and now vested in her<FootnoteRef Ref="f00002"/>, makes the following Order:</Text>

<Title>Title, application and commencement</Title>

<Text>This Order may be cited as the Mink Keeping (Prohibition) (England) Order 2004, shall apply in England, and shall come into force on the day after the day on which it is approved by resolution of each House of Parliament.</Text>

<Text>The keeping of mink <Emphasis>(“mustela vison”)</Emphasis> is prohibited.</Text>

<Text>This Order, in exercise of the power granted to the Secretary of State by section 10 of the Destructive Imported Animals Act 1932 (“<Abbreviation Expansion="Destructive Imported Animals Act 1932 c. 12">the Act</Abbreviation>”), prohibits the keeping of mink in England and replaces the Mink Keeping Order 2000 (<Acronym Expansion="Statutory Instrument">S.I.</Acronym> <Citation URI="http://www.legislation.gov.uk/id/uksi/2000/3402" id="c00001" Class="UnitedKingdomStatutoryInstrument" Year="2000" Number="3402">2000/3402</Citation>), which ceased to have effect on 1st January 2004. <Text>Section 10 of the Act provides that, in relation to an Order made pursuant to that section, the provisions of the Act apply as they apply to musk rats, subject to such exceptions and modifications as may be specified in the Order.  In this Order, exceptions are made in relation to sections 5(2) and 6(2) of the Act. These exceptions relate to the duty on occupiers of land to give notice of the presence on their land of mink not kept under a licence.</Text>

<Text>A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.</Text>
