<Text>These Regulations may be cited as the Social Security (Categorisation of Earners) Amendment Regulations 2003, and shall come into force on 6th April 2003.</Text>

<Title>Interpretation</Title>

<Text>In these Regulations “the <Abbreviation Expansion="Social Security (Categorisation of Earners) Regulations 1978 (S.I. 1978/1689)">principal Regulations</Abbreviation>” means the Social Security (Categorisation of Earners) Regulations 1978<FootnoteRef Ref="f00002"/>, and a reference to a numbered Schedule is a reference to the Schedule to the principal Regulations bearing that number.</Text>

<Title>Amendment of Schedule 1</Title>

<Text>In paragraph 5A of Schedule 1 (entertainers treated as employed earners)<FootnoteRef Ref="f00003"/> for the entry in Column (B) substitute—</Text>

<Text>These Regulations amend the Social Security (Categorisation of Earners) Regulations 1978 (<Acronym Expansion="Statutory Instrument">S.I.</Acronym> <Citation URI="http://www.legislation.gov.uk/id/uksi/1978/1689" id="c00001" Class="UnitedKingdomStatutoryInstrument" Year="1978" Number="1689">1978/1689</Citation>) (“the principal Regulations”).</Text>

<Text>Regulation 1 provides for the citation and commencement of the Regulations and regulation 2 for interpretation.</Text>
</P>
<P>
<Text>Regulation 3 amends Schedule 1 to the principal Regulations by substituting a new paragraph 5A for that added to Schedule 1 by regulation 3 of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1998/1728" id="c00002" Class="UnitedKingdomStatutoryInstrument" Year="1998" Number="1728">1998/1728</Citation>. That regulation would originally have applied only until 31st January 1999, but the temporal limitation was removed by regulation 2 of S.I. <Citation URI="http://www.legislation.gov.uk/id/uksi/1999/3" id="c00003" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="0003">1999/3</Citation>. As substituted, paragraph 5A provides that an entertainer’s employment is to be treated as employed earner’s employment unless his remuneration does not include any payment by way of salary (as defined).</Text>

<Text>Regulation 4 makes an amendment to Schedule 3 to the principal Regulations, the effect of which is to treat the producer of the entertainment, in respect of which the payment of salary is made, as the secondary contributor for the purposes of making secondary Class 1 contributions.</Text>
